These Terms and Conditions ("Terms") govern your access to and use of the website allindiatender.com and any related services (collectively, the "Platform") operated by All India Tender Solutions (OPC) Private Limited ("we", "us", "our", or "the Company"), a company incorporated in India with CIN U70200GJ2026OPC178420.

By accessing, registering on, or using the Platform, you ("User", "you", "your") agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

The Platform is a government tender intelligence service. It aggregates publicly available tender notices, requests for proposals, expressions of interest, and similar procurement opportunities from Indian government portals (including but not limited to GeM, CPPP, IREPS, CPWD, and state e-procurement portals) and presents them in a searchable, filterable, alert-enabled format.

We may also offer related services such as bid document preparation assistance, DSC procurement, MSME/Udyam/NSIC registration, ISO certifications, tender consulting, and similar business-support services (collectively, "Services").

2. Eligibility

• You must be at least 18 years old and legally competent to enter into a binding contract under the Indian Contract Act, 1872.
• You must be using the Platform on behalf of yourself or a business/organisation you are authorised to represent.
• You must provide accurate, current, and complete information during registration and keep it updated.

3. Account Registration & Security

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities conducted under your account.
• You must notify us immediately of any unauthorised access or use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are inactive for an extended period.

4. Subscriptions, Plans & Payment

• Some features of the Platform are free; others require a paid subscription (Basic, Pro, Enterprise) or a one-time service fee.
• Prices are listed on the Platform and are exclusive of GST unless stated otherwise.
• Payments are processed by third-party payment gateways (Razorpay, Cashfree, CCAvenue and similar). You agree to comply with their terms in addition to ours.
• All subscriptions auto-renew at the end of each billing cycle unless cancelled before the renewal date. You can cancel from your account dashboard at any time.
• GST invoices are issued for every successful payment and made available in your account.

5. Use of the Platform

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You will not:

• Use the Platform in any way that violates Indian law or any other applicable law.
• Scrape, crawl, or systematically download Platform content using automated tools, except as permitted via official APIs.
• Reverse-engineer, decompile, or attempt to extract source code from the Platform.
• Resell, redistribute, or sublicense the Platform or its data to third parties without our written consent.
• Use the Platform to send spam, phishing messages, or unsolicited commercial communications.
• Attempt to gain unauthorised access to any portion of the Platform, other accounts, or our infrastructure.
• Impersonate another person or misrepresent your identity, organisation, or affiliation.
• Upload viruses, malware, or any other harmful code.

6. Intellectual Property

All content on the Platform that is created by us — including software, design, logos, trademarks, text, graphics, the "All India Tender" and "All India Tender" brand names, classifications, summaries, analytics, and aggregated views — is the intellectual property of the Company or its licensors and is protected by Indian and international intellectual property laws.

Tender notices and bid documents themselves are public-domain government information; we do not claim ownership over the underlying notices but do claim ownership over our compilation, classification, presentation, and analytics layers.

You are granted a limited, non-exclusive, non-transferable licence to use the Platform for your own bidding and procurement-research purposes.

7. Accuracy of Information

We make commercially reasonable efforts to ensure tender information is accurate, current, and complete. However:

• Tender notices originate from third-party government portals; we do not control their accuracy.
• Tenders may be withdrawn, corrigended, extended, or cancelled by the issuing authority without notice.
• You are responsible for verifying critical details (deadline, eligibility, EMD, technical specifications) directly with the issuing authority before submitting a bid.
• The Platform is provided "as is" without warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, the Company, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost bids, missed deadlines, lost contracts, or business interruption, arising out of or in connection with your use of the Platform.

In all cases, our aggregate liability to you for any claim arising from these Terms or the Platform shall not exceed the amount you have paid to us in the preceding twelve (12) months.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, and affiliates from and against any claims, damages, liabilities, losses, or expenses (including legal fees) arising out of your breach of these Terms, your violation of any law or third-party right, or your misuse of the Platform.

10. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination (intellectual property, limitation of liability, indemnification, governing law) will continue to apply.

11. Modifications to the Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Material changes will be notified through the Platform or by email. Your continued use of the Platform after such changes constitutes acceptance of the updated Terms.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts at Ahmedabad, Gujarat, India.

13. Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, pandemics, war, civil unrest, internet or telecommunication failures, government actions, or third-party portal/service outages.
